The Finance Act 2023 added a new section, 194BA, to the Income-tax Act, 1961, starting from 1 April 2023. We are required to deduct TDS from players' accounts based on their Net Winnings.
Following events act as TDS events
1. Any withdrawal done during the year
2. Final calculation done at the end of fiscal year
TDS is always calculated on Net Winnings and will be deducted at the rate of 30% of Net Winnings. If aggregate Net Winnings are less than ₹100 in a fiscal year, then no TDS is deducted.

Scenario 1 :
On March 30, 2023, you have ₹20,000 in your account. You choose to withdraw this amount on April 10, 2023.
On April 1, 2023, the ₹20,000 in your account is identified as C, your account's opening balance for the year. This amount is taken into account in the income tax deduction calculation.
The calculation for net winnings is defined as A - (B + C), where:
A: The amount you're withdrawing from your account, which is ₹20,000 in this case.
B: The total deposit you made during the financial year up to the time of withdrawal. In this case, B is ₹0 as no deposit is made during the financial year.
C: Your account's opening balance at the start of the financial year, which is ₹20,000 in this case.
Hence, your net winnings = ₹20,000 - (₹0 + ₹20,000) = ₹0.
Therefore, no income tax will be deducted since your net winnings total ₹0.

Scenario 2
On April 1, 2023, your account has an opening balance of ₹10,000 (C). During the financial year, you make two deposits: the first one of ₹2,000 and the second one of ₹4,000, totaling to ₹6,000 (B). You win some games and your wallet balance increases to ₹17,000. Later, you decide to withdraw ₹17,000 (A).
The formula to calculate your net winnings is defined as A - (B + C + E).
E represents the net winnings from previous withdrawals during the financial year up until the time of the current withdrawal. In this scenario, E is ₹0 because this is your first withdrawal of the financial year.
So, the calculation of your net winnings goes as follows:
Net Winnings = ₹17,000 - (₹6,000 + ₹10,000 + ₹0) = ₹1,000
Therefore, your net winnings total to ₹1,000.
The TDS (Tax Deducted at Source) applicable on your net winnings is calculated at a rate of 30%. Hence, the TDS on your net winnings would be:
TDS = 30% of ₹1,000 = ₹300
This means ₹300 will be deducted from your net winnings as tax.

Scenario 3
Continuing from Scenario 2, now you then make an additional deposit of ₹5,000, increasing your total deposits for the year (B) to ₹11,000. You subsequently withdraw another ₹5,000, bringing the total amount withdrawn (A) to ₹22,000.
Since you've already made a withdrawal earlier, E now represents the net winnings from the previous withdrawal on which TDS was deducted, which is ₹1,000.
So, the calculation of your net winnings for the second withdrawal would be:
Net Winnings = ₹22,000 (A) - (₹11,000 (B) + ₹10,000 (C) + ₹1,000 (E)) = ₹0
Since your net winnings total ₹0, no additional TDS will be deducted at this point.

Scenario 4
Continuing from Scenario 3, you then make an additional deposit of ₹10,000 and win some games, increasing your wallet balance to ₹15,000. You do not make any more withdrawals till year end. This becomes your closing balance (D) at the end of the financial year.
To calculate your net winnings at the end of the year, the formula is (A + D) - (B + C + E). So, the calculation of your net winnings at the end of the financial year would be:
Net Winnings = (₹22,000 (A) + ₹15,000 (D)) - (₹21,000 (B) + ₹10,000 (C) + ₹1,000 (E)) = ₹5,000
As your net winnings total ₹5,000, a TDS (Tax Deducted at Source) at the rate of 30% is applicable on these winnings. Therefore, TDS would be:
TDS = 30% of ₹5,000 = ₹1,500
This means ₹1,500 will be deducted from your net winnings as tax.

Notes
No carry forward of Net Winnings or Losses to the next Financial Year shall be permitted.
Users will be permitted to withdraw their winnings only after they provide their PAN details and only after the TDS has been deducted from the amounts withdrawn. Rummy Passion will verify the PAN details of its users from time to time. Rummy Passion has the right to forfeit any winnings in cash or kind if the users PAN details are unverifiable, incorrect or are found to be inaccurate during verification. Failure by the user to provide correct PAN details to Rummy Passion as per its Terms of use will result in their inability to make a withdrawal from their account. It is the users responsibility to provide their PAN card details to Rummy Passion in order to claim any refund based on their TDS return filing.
If the user does not provide their PAN details before the end of the Financial Year, Rummy Passion will deduct TDS on positive Net Winnings at the end of the Financial Year and pay to the government authorities on a nameless basis. In such a case the user will not be able to claim any refund on such TDS paid while filing their income tax returns and Rummy Passion will not be liable.
TDS and / or any other taxes levied by the Government of India are subject to change and all applicable taxes will be deducted from the users account. All rates mentioned herein are exclusive of surcharge and cess as may be applicable. Rummy Passion will provide the user, a certificate of taxes deducted on request. Rummy Passion is not a tax advisory body and is in no way responsible for the users tax liability or filing.
For real money games, contests, tournaments, marketing events and loyalty points program, Rummy Passion levies a service charge commonly known as ‘Rake’. The rake is a gross percentage levied for facilitation of game play which is inclusive of applicable GST. Any action by you to introduce and transmit such content that may contain computer viruses or computer contaminants as described in the Information Technology Act 2000 or other laws applicable in India which may sabotage and stop or limit the functionality of software, equipment or machinery owned or operated by RummyPassion.com or which is used for providing products and services by RummyPassion.com is strictly prohibited.
Seeking another person’s user ID, password, account details or personal details or accessing the email database of users or gathering their personal details including recording their activity on the RummyPassion.com Platform is strictly prohibited.
Any person or persons who are employees, directors, officers or agents of Rummy Passion or are related to such persons, are not allowed to play any Real Money Games on the RummyPassion.com Platform, other than in the course of their employment with Rummypassion.com. Related persons in this case refers to any person or persons who are legally related to employees, directors, officers or agents of Rummy Passion and include spouse, financially dependent children and financially dependent parents.

You will be able to make payments into your user account using accepted payment instruments which you are authorized to use. RummyPassion.com may restrict the amount of money you can add to your user account as management at RummyPassion.com wants you to play responsibly.
Processing of payments made via credit card, debit card, e-wallets, prepaid cash cards and internet banking are processed through gateways owned and operated by third-party payment. As third parties who process such payments require authorization, RummyPassion.com is not responsible for disruptions, denials or delays caused at the payment processors end. Only when your transaction is authorized, the funds will be credited to your user account and will be available for you to participate in Cash Games.
RummyPassion.com can cancel a transaction at any time based on its discretion. If before the transaction is cancelled, the payment is successful, the transaction will be reversed. The money in such case will be credited back to your payment instrument. You may make as many withdrawals as you like as long as they are within the daily withdrawal limit as per your tier. Instant withdrawal charges may be applied as per your instant withdrawal tier limit.
You can send a withdrawal request to withdraw your winnings. All bonuses including promotional winnings can only be withdrawn when they are converted to withdrawable balance by wagering (on cash games or tournaments) and when you have made a minimum of one cash deposit and played at least one cash game at RummyPassion.com. Our effort is to process your withdrawals within the stipulated time but there could be delays because of time needed to complete verification and completion of the withdrawal transaction. However, once your withdrawal is approved by us, you should receive it within 24 hours.
